These Terms of Use (“Terms”) govern access to and use of the web-based application programming interfaces made available at api.busww.com (the “APIs”), which are maintained by Bushnell WebWorks (“Bushnell WebWorks,” “we,” “us,” or “our”).
By accessing or using the APIs, you (“you” or “User”) agree to these Terms. If you do not agree, do not access or use the APIs.
“APIs” means all endpoints, services, documentation, updates, and related materials made available at or through api.busww.com.
“Authorized Software Instance” means a specific software application instance explicitly permitted by Bushnell WebWorks to access the APIs, typically identified by issued credentials, configuration, allowlisting, usage limits, or other access controls determined by us.
“Third-Party Services” means services not operated by Bushnell WebWorks that may be accessed, proxied, or otherwise used in connection with the APIs (for example, AI/ML providers and other hosted services).
You represent that you are legally able to enter into these Terms and that you have authority to bind yourself (and, if applicable, your employer or organization) to these Terms.
Subject to your ongoing compliance with these Terms, Bushnell WebWorks grants you a limited, revocable, non-exclusive, non-transferable license to access and use the APIs solely:
from an Authorized Software Instance, and
only for the purpose(s) expressly permitted by Bushnell WebWorks.
All other uses are strictly prohibited. The APIs are not offered for general public or open-ended use, and no implied rights are granted.
You must not, and must not allow any third party to:
Use the APIs from any software instance that is not an Authorized Software Instance.
Use the APIs for any purpose not explicitly permitted by Bushnell WebWorks.
Bypass or attempt to bypass restrictions, access controls, authentication, allowlists, usage limits, or rate limits.
Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying components of the APIs (except to the extent such restriction is prohibited by applicable law).
Use the APIs to build, improve, train, or provide a product or service that is competitive with or substantially similar to the APIs or any Bushnell WebWorks offering.
Use the APIs to scrape, harvest, or collect data at scale, including through automated means, except as expressly permitted by us in writing.
Interfere with or disrupt the integrity or performance of the APIs or related systems, including via denial-of-service attacks or excessive requests.
Use the APIs in violation of any law, regulation, or third-party rights (including intellectual property, privacy, publicity, or contractual rights).
Submit or transmit any content that is unlawful, harmful, infringing, or that you do not have the right to use.
We may investigate suspected violations and may suspend or terminate access as described below.
If we provide you with API keys, tokens, certificates, or other credentials (“Credentials”), you must:
Keep Credentials confidential and secure.
Not share, sell, transfer, sublicense, or otherwise disclose Credentials to any third party.
Use Credentials only from Authorized Software Instances.
Notify us promptly at inquiries@api.busww.com if you suspect unauthorized access or compromise.
You are responsible for all activity performed using your Credentials, whether authorized by you or not.
Some or all APIs may be subject to rate limits, quotas, concurrency limits, or other usage controls determined by us in our sole discretion. The APIs may:
reject requests,
throttle throughput,
delay responses, or
temporarily or permanently restrict access
when we determine that usage limits have been exceeded or that your usage may threaten stability, security, or compliance.
We are not liable for any losses arising from rate limiting, throttling, rejection of requests, or other usage control measures.
The APIs may proxy, relay, transform, filter, constrain, or otherwise interact with Third-Party Services. You acknowledge and agree that:
Third-Party Services are not controlled by Bushnell WebWorks.
The APIs may include modifications intended to impose safety, policy, cost, performance, or usage constraints.
Third-Party Services may change, degrade, suspend, or discontinue without notice.
Your use of Third-Party Services may be subject to separate terms, policies, or requirements from those third parties, and you are responsible for complying with them as applicable.
Bushnell WebWorks is not responsible for outages, failures, latency, subscription issues, provider-side policy enforcement, or other breakdowns in networking or communication with Third-Party Services.
The APIs may return content, data, recommendations, or other output that originates from or is influenced by Third-Party Services. You acknowledge and agree that:
Output may be inaccurate, incomplete, misleading, offensive, or unsuitable for your intended use.
You are solely responsible for evaluating output and for any decisions or actions taken based on output.
Bushnell WebWorks does not endorse, guarantee, or assume responsibility for the accuracy, legality, quality, or reliability of any output returned by the APIs.
You agree not to rely on API output as a substitute for professional advice (including legal, medical, financial, or safety advice) where such reliance could cause harm.
THE APIS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUSHNELL WEBWORKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the APIs will be uninterrupted, error-free, secure, or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
BUSHNELL WEBWORKS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR SUBSTITUTE PROCUREMENT, ARISING OUT OF OR RELATED TO THE APIS OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BUSHNELL WEBWORKS’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APIS OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO BUSHNELL WEBWORKS FOR API ACCESS IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.
Some jurisdictions do not allow certain limitations; in that case, the above limitations apply to the greatest extent permitted.
You agree to defend, indemnify, and hold harmless Bushnell WebWorks and its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or relating to:
your access to or use of the APIs,
your breach of these Terms,
your violation of any law or third-party right, or
your content, data, or materials submitted to or processed through the APIs.
We may suspend or terminate your access to the APIs at any time, with or without notice, if we believe you have violated these Terms, pose a security risk, or if continued operation is not feasible.
Upon termination, all rights granted to you under these Terms immediately cease, and you must stop using the APIs and delete any Credentials.
We may modify, replace, suspend, or discontinue the APIs (in whole or in part) at any time. We may also update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the APIs after changes become effective constitutes acceptance of the updated Terms.
Your use of the APIs may involve transmission of data you provide (“Input”) to us and/or to Third-Party Services for processing in order to generate output. You represent and warrant that you have all rights and permissions necessary to provide Input and that doing so does not violate any law or third-party rights.
Do not submit sensitive personal data (e.g., government IDs, financial account numbers, health data) unless Bushnell WebWorks has explicitly agreed in writing to accept and process such data with appropriate safeguards.
We may log metadata about API requests (such as timestamps, endpoint calls, usage volume, and error codes) for security, abuse prevention, and operational purposes.
Bushnell WebWorks retains all right, title, and interest in and to the APIs, including all related intellectual property rights. Except for the limited license granted in these Terms, nothing transfers to you.
You may not use the APIs if you are located in, under the control of, or a national or resident of any country subject to applicable embargoes or sanctions, or if you are otherwise prohibited from receiving the APIs under applicable export control or sanctions laws.
These Terms are governed by the laws of California, U.S.A., without regard to conflict-of-law rules. Any dispute arising from or relating to these Terms or the APIs will be brought exclusively in the state or federal courts located in Los Angeles, California, U.S.A., and you consent to personal jurisdiction and venue there.
Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms.
No Waiver. Failure to enforce a provision is not a waiver.
Entire Agreement. These Terms are the entire agreement regarding the APIs and supersede prior understandings on this subject.
Force Majeure. We are not liable for delays or failures due to events beyond reasonable control (including provider outages, network failures, and third-party service disruptions).
